Lawful applications only
Cadaber Diesel provides products, files, programming and services only for uses permitted by applicable federal, state, provincial, local and other law. The customer is responsible for determining whether a requested product or service is lawful for the specific vehicle, engine, equipment, location and intended use.
Emissions and road-use compliance
Cadaber Diesel does not authorize, encourage or condone tampering with, disabling, bypassing or removing emissions-control or safety equipment where prohibited by law. A competition, racing, export, research or off-highway description does not by itself make a modification legal. Any service represented for a limited-use application must remain exclusively within that lawful application and must not be installed or used on a public-road vehicle when prohibited.
Customer representations
By purchasing, requesting or using a product or service, the customer represents that all information supplied about the application and intended use is accurate; that the customer has authority to modify the vehicle or equipment; and that the resulting installation and use will comply with all applicable laws, permits, rules and regulations.
Installation, operation and risk
Modified vehicles and equipment may behave differently from factory configuration and may experience increased mechanical, thermal or drivetrain stress. Proper installation, inspection, maintenance, instrumentation and safe operation remain the responsibility of the vehicle or equipment owner and operator. Stop operation and seek qualified inspection if warning signs, abnormal behavior or unsafe conditions occur.
No guaranteed result
Results vary with vehicle condition, supporting hardware, fuel, environment, prior modifications, maintenance and operation. Unless expressly stated in a signed writing, Cadaber Diesel does not guarantee a particular horsepower, torque, fuel economy, emissions result or fitness for a specific purpose.
Warranty and third-party coverage
Aftermarket products or modifications may affect manufacturer, dealer, component or insurance coverage. The customer is responsible for reviewing all applicable warranties, leases, financing terms and insurance requirements before authorizing work.
Limitation of liability
To the fullest extent permitted by law, Cadaber Diesel will not be liable for indirect, incidental, special, exemplary or consequential loss arising from installation, misuse, unlawful use, racing, competition, abuse, neglected maintenance, inaccurate customer information or operation outside the agreed application. Nothing in these terms excludes liability that cannot lawfully be excluded.
Indemnification
To the fullest extent permitted by law, the customer agrees to defend, indemnify and hold Cadaber Diesel harmless from third-party claims, penalties, losses and reasonable costs arising from the customer’s unlawful use, unauthorized resale, misrepresentation, installation or operation of a product or service, except to the extent caused by Cadaber Diesel’s liability that cannot lawfully be limited.
